Additional Contest Rules and Regulations
The Vegan Milk Revolution Contest is designed to encourage you to create and post a Youtube video telling your story or a short commercial describing the benefits of switching from cow’s milk to vegan milk. Please keep videos to 5 minutes or less. We’d love to hear from our international friends, but because of legal and tax issues, we have to keep it to U.S. only. We’re giving some cool prizes, but the point is really to inspire you to use your voice and tell the world the benefits of switching to non-dairy.
Eligibility: This above described contest (the “Contest”) is open to all legal residents of the 50 United States and District of Columbia. Prizes will be awarded to the legal guardian of any contestant under 21 years of age. Prize winners are subject to proving eligibility, including verification of social security number, and are further subject to possessing a valid government-issued photographic identification at the time of prize fulfillment. If any potential prize winner cannot furnish verifiable and valid proof of age within 48 hours of request, then all rights of such potential winner to receive and use the prizes will be terminated and an alternate potential winner may be chosen from among all remaining eligible entries received, in the sole discretion of Pamela Ziemann. (the “Contest Founder”).
Terms and Conditions: By participating in this contest, contestants hereby (i) agree to be bound by the rules and regulations set forth in the Contest announcement and set forth herein (collectively, the “Rules”) and by any interpretations of these Rules by the Founder and by the decisions of the Founder, which are final in all matters relating to this Contest, (ii) agree to the terms and conditions with respect to all travel arrangements, (iii) release and hold harmless Pamela Ziemann and sponsors or prize donators in connection with this Contest, and their respective agents, employees, officers, directors, successors and assigns, against any and all claims, injury or damage arising out of ore relating to participation in this Contest and/or use or misuse or redemption of any of the listed prizes and for any claims based on publicity rights, defamation, invasion or privacy, copyright infringement, trademark infringement, or any other causes of action. All Contest winners agree that the Founder, and any and all judges, sponsors and prize donators, shall have no liability in connection with acceptance or use of any of the prizes awarded in the Contest.
Restrictions: Contest entries must not contain any defamatory materials or elements, crude, vulgar or offensive pictures, depictions, images, language and/or symbols, nudity, commercial products and/or their trademarks, brands, logos or endorsements, derogatory characterizations, any assault or threatening of others, or any other content, display, materials and/or images that could be considered inappropriate as determined by the Founder, it is sole discretion.
Voting: The determination of the number of votes shall be final and binding. All contestants by participating in the Contest hereby agree to waive any claims against the Founder and any and all sponsors and prize donators, relating to the judging or awarding process of this Contest. The Company reserves the right to extend the Contest period or not to award any or all prizing if it determines, in its sole discretion, that entries received did not meet the qualification standards.
Winners: When the 7 prize winners are chosen, the Company will make two (2) attempts to notify each of the potential winners using the contact information provided during such contestant’s Contest submission. Each potential prize winner must respond within twenty-four (24) hours. If any potential winner is unreachable (or is reached by fails to confirm his/her identity and eligibility) within twenty-four (24) hours of initial contact, or if any of the selected potential winners fail to comply with any of the Rules, then all rights of such potential winner thereupon shall be terminated, and an alternate potential winner shall be selected from the remaining eligible entires by and at the sole discretion of the Company.
Costs: Any costs and expenses which are not specifically mentioned as being included in the prizes, including, without limitation, ground transportation to and from airports, meals, gratuities, luggage fees, phone calls, and any and all other travel and incidental expenses are each winning contestant’s sole responsibility. Once trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at the Founder’s sole discretion. The Founder shall not be liable for any loss or damage to baggage. Contest winners are solely responsible for obtaining all necessary and required travel documents and insurance. All airline tickets issued in conjunction with the first place prize are not eligible for frequent flyer miles, and no code-share flights may be used. The first place prize cannot be used in conjunction with any other promotion or offer, and no portion may be separated except at the Founder’s sole discretion. Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purposes.
Contest Entries: Each contestant into the Contest hereby irrevocably grants, transfers, assigns and conveys to the Founder, its successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including without limitation, all copyrights, and all rights incidental, subsidiary, ancillary or allied thereto (including without limitations, all derivative rights) in and to their Contest entry for exploitation throughout the universe, in perpetuity, by means of any and all media devices whether now known or hereafter devised. The Founder shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Contest entries for any purpose which the Company deems necessary or desirable, and each contestant irrevocably waives any and all so-called moral rights they may have therein. Each eligible contestant hereby acknowledges that such contestant does not reserve any rights in or to their Contest entry.
Release: As a prerequisite for receiving any Contest prize, the potential prize winners must complete, sign and return to the Founder, within two (2) days after the date of the Founder’s request therefor and presentation thereof, (a) an affidavit of eligibility and release of the Founder from any and all liability, claims, demands, judgments, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this Founder or the use or acceptance of the prizes (or any portion thereof); (b) except where prohibited by law, a promotional release granting to the Founder the right to use such prize winners and their name and likeness for any and all advertising, marketing, promotional and publicity purposes, without additional compensation; and (c) all legal documents that the Founder may required (in its sole discretion). Failure of any potential Contest winner to complete, sign and return to the Founder such affidavit, release and legal documentation within two (2) days period shall result in his/her disqualification from the Contest, in which event and alternate potential Contest winner may be selected, in the Founder’s sole discretion. Entry into this Contest constitutes each potential Contest winner’s agreement to sign such affidavit, release and legal documentation.
State and Local Laws: The value of the prize(s) may be taxable as income. The receipt by any Contest prize winner is conditioned upon his/her compliance with any and all applicable federal, state and local taxes, rules and regulations. Any violation of these Rules by any winner (as determined by the Company in its sole discretion) will result in such winner’s disqualification from any further participation in this Contest, and any and all benefits and privileges potentially to be accorded to such winner will be terminated immediately, irrevocably and in perpetuity.
Rules: All interpretations by the Founder of the Rules, and all decisions by the Founder under and relating to the Rules, are final, binding and non-appealable in all respects. The Founder reserves the right, exercisable in its sole discretion at any time, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest; to be acting in violation of the Rules; or to be acting in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEB SITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD ANY SUCH ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT (EXERCISABLE IN ITS SOLE DISCRETION AT ANY TIME) TO SEEK AND OBTAIN DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE WASHINGTON COURTS (STATE AND FEDERAL) SHALL HAVE EXCLUSIVE PERSONAL AND SUBJECT MATTER JURISDICTION AND VENUE OF ANY CONTROVERSY, DISPUTE OR OTHER LEGAL PROCEEDING REGARDING THE CONTEST, AND THE LAWS OF THE STATE OF WASHINGTON SHALL GOVERN THE CONTEST. EACH ENTRANT IN THIS CONTEST HEREBY WAIVES IRREVOCABLY AND IN PERPETUITY ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS IRREVOCABLY AND IN PERPETUITY TO THE EXCLUSIVE PERSONAL AND SUBJECT MATTER JURISDICTION AND VENUE OF THOSE COURTS.
General Conditions of Participation: Entrants hereby agree to submit their Contest entry under the following terms and conditions: (i) that all materials submitted become the property of the Company and will not be returned; (ii) that all materials submitted are free from any lien or claim by anyone; (iv) Contest entrants have obtained all rights, permissions and licenses necessary to use their Contest entry for any purpose; (v) that no Contest entry, or any part thereof, infringes any trademark or copyright or otherwise violates anyone’s right of privacy or publicity or any other right; (vi) by submitting a Contest entry, entrants consent to the Founder or its licensees exploiting such entry (any and all copyrighted elements contained therein), in all media now known or hereafter devised worldwide in perpetuity; and (vii) entrants indemnify and hold harmless the Founder, and any and all sponsors or prize donators, from any claims, suits, losses damages and expenses (including reasonable attorneys’ fees) that arise from any breach of the following conditions. Entrants agree to the foregoing and in addition agree to obtain, upon request of the Founder, any documentation and releases necessary to prove their unrestricted ownership in all materials contained in their Contest entry and their right to use such materials without limitation for any purpose. They further agree to assign all right, title and interest in all material and agree to sign such documentation as is necessary to formalize this assignment.
